LOUISIANA — Since the implementation of Louisiana’s controversial unlicensed concealed carry law on July 4, 2024 it appears a new legal tactic has emerged that some are calling a loophole for law enforcement. Reports indicate that law enforcement agencies in the State of Louisiana are utilizing a little-known provision called “negligent carrying of a concealed handgun” to make arrests, despite the new law’s intent to expand citizens’ rights to carry firearms.
The law, championed by Governor Jeff Landry as a move to uphold Second Amendment rights, has sparked both support and concern among residents. Proponents argue that it empowers law-abiding citizens to protect themselves, while critics fear it could escalate gun violence. However, the recent arrests under the negligent carrying provision have added a layer of complexity to the debate.
According to legal definitions, negligent carrying of a concealed handgun occurs when there is a foreseeable risk of the handgun discharging or when its presence creates reasonable fear among the public or law enforcement of an imminent crime. This broad interpretation has allowed officers discretion in determining when to enforce it.
Love Shreveport-Bossier Media has uncovered at least four arrests in Bossier City, Louisiana under this provision since July 4th, prompting further investigation into its application statewide. Other law enforcement agencies are being queried for similar cases, and efforts to obtain official comments from Bossier City Police Public Information Officer Louis Johnson are currently underway.
Meanwhile, Shreveport Police Department Public Information Officer CPL Chris Bordelon confirmed that no arrests have been made in Shreveport, Louisiana using this provision since the new unlicensed conceal carry law took effect.
Critics argue that such arrests undermine the spirit of the new law, potentially criminalizing lawful gun owners who inadvertently cause alarm due to public perception. Conversely, supporters of the provision assert that it maintains public safety by holding individuals accountable for irresponsible firearm handling, regardless of their legal right to carry.
The unfolding situation underscores the complexities of balancing public safety with individual liberties in the realm of gun rights. As debates continue both in legislative chambers and on the streets of Louisiana, the enforcement of the negligent carrying provision remains a pivotal point of contention among lawmakers, law enforcement officials, and the public alike.
